1. Acceptance of terms
By creating an account or using the Simuletic Service (website, studio, marketplace, APIs and downloadable datasets), you agree to these Terms & Conditions. If you are accepting on behalf of a company, you represent that you have authority to bind that company.
2. The Service
Simuletic provides synthetic image and dataset generation, a marketplace of curated YOLO-formatted datasets and tools to fine-tune vision models. The Service is offered under several subscription tiers and as one-off marketplace purchases.
3. Accounts & eligibility
- You must be at least 16 years old and able to enter a binding contract.
- Account information must be accurate and kept up to date.
- You are responsible for safeguarding your credentials and for any activity on your account.
- One person or organization per account unless we agree otherwise in writing.
4. Subscriptions, credits & billing
- Subscriptions are billed monthly via Stripe in the currency shown at checkout.
- Upgrades take effect immediately and are pro-rated; you receive the new tier's credits right away.
- Downgrades take effect at the end of your current billing period; your existing credits remain available until then.
- Monthly subscription credits reset at each renewal and do not roll over.
- Top-up credits are persistent and do not reset at renewal.
- All fees are non-refundable once credits have been consumed, except where required by law.
- Failure to pay may result in suspension or termination of your account.
5. Safe payments
All payments are processed by Stripe, a PCI-DSS Level 1 certified payment provider. Simuletic never receives or stores your card details. Stripe's own terms and privacy policy apply to the payment transaction.
6. Licensing of generated content
Subject to your payment of all applicable fees, you own the synthetic images and YOLO annotations you generate through the Service. Simuletic grants you, and you retain, a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, redistribute and commercially exploit your generated content, including for training, evaluating and deploying machine-learning models, and for embedding into your products.
7. Marketplace dataset license
Datasets purchased from the marketplace are licensed to you under a perpetual, worldwide, non-exclusive commercial license to use the dataset to train, evaluate and deploy your own models, and to redistribute derived models freely. You may not resell, sublicense or publicly republish the raw dataset files themselves. Attribution is appreciated but not required.
8. Reference uploads
When you upload images as references for image-to-image generation, you warrant that you own them or have all necessary rights and permissions, including consent from any identifiable individuals.
9. Acceptable use
You agree not to use the Service to generate, request or distribute:
- Child sexual abuse material (CSAM) or any sexual content involving minors.
- Realistic likenesses of identifiable real persons without their explicit consent.
- Content used for unlawful surveillance, harassment, discrimination or defamation.
- Content that violates export-control, sanctions or weapons laws applicable to you.
- Malware, phishing material or content designed to deceive.
You also agree not to reverse engineer, scrape at scale, or attempt to circumvent rate limits, credit accounting or access controls.
10. Platform IP
Simuletic and its licensors retain all rights in the platform, the underlying models, software, generation pipelines, brand and documentation. These Terms grant you no rights in our IP beyond the licenses expressly stated.
11. Disclaimer
The Service and all generated content are provided "as is" and "as available". Synthetic data is intended to augment, not replace, real-world evaluation. You are solely responsible for testing models trained on Simuletic data before deploying them, especially in safety-critical applications.
12. Limitation of liability
To the maximum extent permitted by law, Simuletic's aggregate liability arising out of or related to the Service is limited to the fees you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, lost profits or lost data.
13. Termination
You may cancel your subscription at any time from your account; the cancellation takes effect at the end of the current billing period. We may suspend or terminate accounts that violate these Terms, with reasonable notice where practicable. On termination, your access ends and your data is retained or deleted in line with our Privacy Policy.
14. Governing law
These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles. The courts of Stockholm have exclusive jurisdiction over any dispute, subject to mandatory consumer protections in your country of residence.
15. Changes
We may update these Terms from time to time. Material changes will be notified by email or in-app notice at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
